I noticed the weight limit is a ridiculous 11 pounds or something but I'm probably still don't have that much weight in them to weight them down much. Thought I smelled something the other day. I wonder if I can just add a few washers to push the bags outwards some which forces them up a little. I have the quick release passenger seat but not the quick release bags.

I thought I had mounted them wrong so on a rainy day took one side off and very carefully following the factory instructions remounted it with no luck. Forget the washer thing, tried it, didn't work. Finally, I spread the brackets as far apart as I could with the bag still on and stuffed a small block of wood in the bracket to keep it from compressing and lowering the bag. Even with that the bag is only and inch or two above the pipe but at least it doesn't touch, even loaded. Not an engineering marvel but it will do until someone comes up with something better. Maybe even Triumph might come up with a fix? Yea, right.

I am not one for travelling light and on my recent trip the bags were well over weight and stuffed full. Still no touch down on the exhaust. Seems odd...

Impressive
I am always very envious when I see I fellow rider on the road on tour full of gear. I just LOVE it!
As for the bags - does it make a difference with short TORS fitted - is that the reason? Or have they changed bag supplier?

No, long TORs sit in exactly the same position as the stock pipes.
The position of the pipes in relation to the rest of the frame (which the bags are bolted to) does not change no matter how much you load the bike up. The rear suspensions only allow the back wheel and swingarm to move up and down.
So if your bags are touching the pipes at all, I'd say it is something wrong with fitment or the bags themselves.
